MINUTES OF PROCEEDINGS


THURSDAY, MARCH 14, 1996

[Translation]

The Sub-Committee on Bill C-3, of the Standing Committee on Human Resources Development, met at 9:08 o'clock a.m. this day, in room 536, Wellington Bldg., the Chair, Larry McCormick, presiding.

Members of the Sub-Committee present: Bonnie Brown, Dale Johnston, Larry McCormick, Réal Ménard and George Proud.

In attendance: From the Research Branch of the Library of Parliament: June Dewetering, Research Officer.

Appearing: The Honourable Alfonso Gagliano, Minister of Labour.

Witness: From the Department of Human Resources Development: Warren Edmondson, General Director, Federal Mediation and Conciliation Service.

The Order of Reference dated March 12, 1996, from the Standing Committee on Human Resources Development is being read as follows:

ORDERED,--That, pursuant to Standing Order 108(1), a Sub-Committee of the Standing Committee of Human Resources Development, composed of Larry McCormick, as the Chair, and of Bonnie Brown, George Proud, Réal Ménard and Dale Johnston, as members, be established for consideration of Bill C-3, An Act to amend the Canada Labour Code (nuclear undertakings) and to make a related amendment to another act, and to report on Bill C-3 to the Committee; and that its report be deemed adopted on presentation and that the Chair of the Committee present it to House on behalf of the Committee.

ORDERED,--That, in any meeting of the Sub-Committee, when the Chair is unable to carry out his functions as Chair of the Sub-Committee, he appoint a member of the said Sub-Committee to preside over the meeting.

ORDERED,--That, unless otherwise ordered by the House, the Sub-Committee be empowered to send for persons, papers and records, to sit while the House is sitting, to sit when the House stands adjourned, to print from day to day such papers and evidence as may be needed, to authorize its Chair to hold meetings when quorum is not present and to receive and authorize the printing of evidence.

ORDERED,--That the Committee grant to the Sub-Committee, from its budget allowance, a sufficient amount of money to pay reasonable living and travelling expenses to witnesses who appear before the Sub-Committee.

ORDERED,--That the Library of Parliament provide a Research Officer to the Sub-Committee.

Clause 1

The Minister made a presentation and, with Warren Edmondson, answered questions.

At 9:55 o'clock a.m., the sitting was suspended.

At 10:00 o'clock a.m., the Sub-Committee resumed in camera to discuss its future business.

At 10:01 o'clock a.m., the Sub-Committee proceeded in public.

It was agreed,--That parties send a list of witnesses to the Clerk before 12:00 o'clock p.m., Friday, March 15, 1996, and that the Clerk invite witnesses to appear before the Committee on Thursday, March 21, 1996.

At 10:09 o'clock a.m., the Sub-Committee adjourned to the call of the Chair.


THURSDAY, MARCH 21, 1996

The Sub-Committee on Bill C-3, of the Standing Committee on Human Resources Development, met at 9:05 o'clock a.m., this day, in room 208, West Block, the Chair, Larry McCormick, presiding.

Members of the Sub-Committee present: Bonnie Brown, Larry McCormick, Réal Ménard and George Proud.

Acting Member present: Sharon Hayes for Dale Johnston.

In attendance: From the Research Branch of the Library of Parliament: June Dewetering, Research Officer.

Witnesses: From the Society of Ontario Hydro Professional and Administrative Employees: Mundy McLaughlin, Staff Officer; Mario Germani, President. From the Power Workers' Union (CUPE, Local 1000, CLC): John Murphy President; Christopher Dassios, Legal Counsel. From the ``Syndicat professionnel des ingénieurs d'Hydro-Québec'': Louis Champagne, President. From the International Brotherhood of Electrical Workers - Local 2309: John Cole, Director; Ray Dixon, Legal Counsel.

The Sub-Committee resumed consideration of Bill C-3, An Act to amend the Canada Labour Code (Nuclear Untertakings) and to make a related amendment to another act (See Minutes of Proceedings dated Thursday, March 14, 1996).

Mario Germani made a presentation and, with Mundy McLaughlin, answered questions.

John Murphy made a presentation and, with Christopher Dassios, answered questions.

At 10:16 o'clock a.m., the sitting was suspended.

At 10:25 o'clock a.m., the sitting resumed.

Louis Champagne made a presentation and answered questions.

John Cole and Ray Dixon made a presentation and answered questions.

At 11:31 o'clock a.m., the Sub-Committee adjourned to the call of the Chair.


THURSDAY, MARCH 21, 1996

The Sub-Committee on Bill C-3, of the Standing Committee on Human Resources Development, met at 3:38 o'clock p.m., this day, in room 208, West Block, the Chair, Larry McCormick, presiding.

Members of the Sub-Committee present: Bonnie Brown, Larry McCormick, Réal Ménard and George Proud.

Acting Member present: Lee Morrison for Dale Johnston.

In attendance: From the Research Branch of the Library of Parliament: June Dewetering, Research Officer.

Witnesses: From the New Brunswick Power Commission: C.F. Baird, Executive Vice-President; Peter J. Dykeman, General Counsel and Corporate Secretary. From the ``Syndicat canadien de la fonction publique (Hydro-Québec) (Local 1500)'': Robert Boisvert, President; Jacques Boucher, President, Local Section 2000; Claude Bélanger, Representative, Local Section 957. The Sub-Committee resumed consideration of Bill C-3, An Act to amend the Canada Labour Code (Nuclear Undertakings) and to make a related amendment to another act (See Minutes of Proceedings dated Thursday, March 14, 1996).

Peter J. Dykeman made a presentation and, with C.F. Baird, answered questions.

Robert Boisvert made a presentation and, with Jacques Boucher and Claude Bélanger, answered questions.

At 4:21 o'clock p.m., the sitting was suspended.

At 4:26 o'clock a.m., the sitting resumed.

Mundy McLaughlin made a presentation and, in conjunction with Warren Edmondson, from the Department of Human Resources Development, answered questions.

At 4:51 o'clock p.m., the Sub-Committee went public and commenced clause by clause consideration of Bill C-3.

On Clause 1

Réal Ménard moved,--That Bill C-3, in Clause 1, be amended by replacing lines 6 to 11, on page 1, with the following:

``121.1 This Part applies in respect of any employment, or any class or classes of employment, on or in connection with a work or undertaking that is, or is part of, a corporation''.

After debate, the question being put to the amendment, it was negatived: Yeas: 1; Nays: 3.

Clauses 1 to 5 carried severally.

The title carried.

The Bill carried.

ORDERED,--That the Chair report Bill C-3 to the Standing Committee.

At 4:55 o'clock p.m., the Sub-Committee adjourned to the call of the Chair.
