SECOND REPORT	DEUXIÈME RAPPORT
In accordance with its Order of Reference of Friday, November 19, 2004, your Committee has considered Bill C-20, An Act to provide for real property taxation powers of first nations, to create a First Nations Tax Commission, First Nations Financial Management Board, First Nations Finance Authority and First Nations Statistical Institute and to make consequential amendments to other Acts, and agreed on Thursday, December 9, 2004 to report it with the following amendments:	Conformément à son Ordre de renvoi du vendredi 19 novembre 2004, votre Comité a étudié le projet de loi C-20, Loi prévoyant les pouvoirs en matière d'imposition foncière des premières nations, constituant la Commission de la fiscalité des premières nations, le Conseil de gestion financière des premières nations, l'Administration financière des premières nations ainsi que l'Institut de la statistique des premières nations et apportant des modifications corrélatives à certaines lois, et a convenu le jeudi 9 décembre 2004, d’en faire rapport avec les amendements suivants :

Clause 2	Article 2
That Bill C-20, in Clause 2, be amended by replacing lines 14 and 15 on page 4 with the following:	Que le projet de loi C-20, à l'article 2, soit modifié par substitution, aux lignes 10 et 11, page 4, de ce qui suit :
the schedule in order to (a)add or change the name of the band; or (b) delete the name of the band, as long as there are no amounts owing by the band to the First Nations Finance Authority that remain unpaid.	l’annexe pour : a) ajouter ou changer le nom de la bande; b) retrancher le nom de la bande, pourvu que toutes les sommes dues par celle-ci à l’Administration financière des premières nations aient été payées.
Clause 4	Article 4
That Bill C-20, in Clause 4, be amended by replacing lines 21 to 24 on page 4 with the following:	Que le projet de loi C-20, à l'article 4, soit modifié par substitution, aux lignes 17 à 21, page 4, de ce qui suit :
4. The council of a first nation may not make a law under paragraph 5(1)(d) until the council has made a law respecting the financial administration of the first nation under paragraph 9(1)(a) and that law has been approved by the First Nations Financial Management Board.	4. “153.1 The Westbank First Nation Self-Government Act is amended by adding the following after section 8: 8.1 Notwithstanding any provision of this Act or the Agreement, for the purpose of enabling the Westbank First Nation to benefit from the provisions of the First Nations Fiscal and Statistical Management Act or obtain the services of any body established under that Act, the Governor in Council may make any regulations that the Governor in Council considers necessary, including regulations (a) adapting any provision of that Act or of any regulation made under that Act; and (b) restricting the application of any provision of that Act or of any regulation made under that Act.	« 153.1 La Loi sur l’autonomie gouvernementale de la première nation de Westbank est modifiée par adjonction, après l'article 8, de ce qui suit : 8.1 Malgré toute autre disposition de la présente loi ou toute disposition de l’accord, le gouverneur en conseil peut, afin de donner à la première nation de Westbank la possibilité de profiter des dispositions de la Loi sur la gestion financière et statistique des premières nations ou d’obtenir les services d’un organisme constitué par celle-ci, prendre les règlements qu’il estime nécessaires, et notamment : a) adapter toute disposition de cette loi ou des règlements pris en vertu de celle-ci; b) restreindre l’application de toute disposition de cette loi ou des règlements pris en vertu de celle-ci. »
