First Reading of Senate Public Bills

Pursuant to Standing Order 69(2), on motion of Mr. Eggleton (Minister of National Defence) for Mr. Collenette (Minister of Transport), seconded by Mr. Nault (Minister of Indian Affairs and Northern Development), Bill S-17, An Act respecting marine liability, and to validate certain by-laws and regulations, was read the first time and ordered for a second reading at the next sitting of the House.


Pursuant to Standing Order 69(2), on motion of Mr. Eggleton (Minister of National Defence), seconded by Mr. Nault (Minister of Indian Affairs and Northern Development), Bill S-18, An Act to amend the National Defence Act (non-deployment of persons under the age of eighteen years to theatres of hostilities), was read the first time and ordered for a second reading at the next sitting of the House.

The House resumed consideration at report stage of Bill C-11, An Act to authorize the divestiture of the assets of, and to dissolve, the Cape Breton Development Corporation, to amend the Cape Breton Development Corporation Act and to make consequential amendments to other Acts, as reported by the Standing Committee on Natural Resources and Government Operations without amendment;

And of the motions in Group No. 2 (Motions Nos. 6 to 11 and 16).

Group No. 2

Mrs. Dockrill (Bras D'Or -- Cape Breton), seconded by Mr. Mancini (Sydney -- Victoria), moved Motion No. 6, -- That Bill C-11 be amended by adding after line 22 on page 3 the following new clause:

      "(1.1) Section 4 of the Act is amended by adding the following after subsection (3):
      (4) One director other than the Chairperson and the President shall be an employee of the Corporation."

Mr. Mancini (Sydney -- Victoria), seconded by Mrs. Dockrill (Bras D'Or -- Cape Breton), moved Motion No. 7, -- That Bill C-11, in Clause 8, be amended by adding after line 22 on page 3 the following:

      "(1.1) Section 4 of the Act is amended by adding the following:
      (4) The majority of the directors shall be residents of the Island of Cape Breton, Nova Scotia."

Mr. Mancini (Sydney -- Victoria), seconded by Mrs. Dockrill (Bras D'Or -- Cape Breton), moved Motion No. 8, -- That Bill C-11, in Clause 8, be amended by adding after line 22 on page 3 the following:

      "(1.1) Section 4 of the Act is amended by adding the following:
      (4) At least one third of the directors shall be members of the Devco Pensioners' Association."

Mrs. Dockrill (Bras D'Or -- Cape Breton), seconded by Mr. Mancini (Sydney -- Victoria), moved Motion No. 9, -- That Bill C-11, in Clause 8, be amended by adding after line 41 on page 3 the following:

      "(4) One director other than the Chairperson and the President shall be an employee of the Corporation."

Mr. Mancini (Sydney -- Victoria), seconded by Mrs. Dockrill (Bras D'Or -- Cape Breton), moved Motion No. 10, -- That Bill C-11, in Clause 8, be amended by adding after line 41 on page 3 the following:

Mr. Mancini (Sydney -- Victoria), seconded by Mrs. Dockrill (Bras D'Or -- Cape Breton), moved Motion No. 11, -- That Bill C-11, in Clause 8, be amended by adding after line 41 on page 3 the following:

Mr. Mancini (Sydney -- Victoria), seconded by Mrs. Dockrill (Bras D'Or -- Cape Breton), moved Motion No. 16, -- That Bill C-11, in Clause 13, be amended

    (a) by replacing line 13 on page 5 with the following:
        "18. (1) The Corporation shall by by-law pro-"
    (b) by adding after line 23 on page 5 the following:
        "(2) The by-law shall provide that at least half of the members of the board or committee that is charged with managing the pension fund are selected by the Devco Pensioners' Association."

Mrs. Dockrill (Bras D'Or -- Cape Breton), seconded by Mr. Mancini (Sydney -- Victoria), moved Motion No. 13, -- That Bill C-11, in Clause 12, be amended by replacing line 35 on page 4 with the following:

    "good mine safety, to provide permanent, full-time employment to the residents of the Island of Cape Breton, Nova Scotia, and to conduct its operations in a manner that benefits the economy of the Island of Cape Breton, Nova Scotia."

Mrs. Dockrill (Bras D'Or -- Cape Breton), seconded by Mr. Mancini (Sydney -- Victoria), moved Motion No. 14, -- That Bill C-11, in Clause 12, be amended by adding after line 10 on page 5 the following:

      "17. The Corporation, in conjunction with the Government of Canada or of Nova Scotia or any agency of either of those governments, shall adopt and continue all reasonable measures deemed necessary to reduce as far as possible the unemployment or economic hardship that is expected to result from the closing, privatisation or reduction in the production of coal."

Mr. Mancini (Sydney -- Victoria), seconded by Mrs. Dockrill (Bras D'Or -- Cape Breton), moved Motion No. 15, -- That Bill C-11, in Clause 12, be amended by adding after line 10 on page 5 the following:

      "17. The Corporation shall adopt all reasonable measures to reduce, to the fullest extent possible, any economic hardship or unemployment that may result from the closing of any coal mine operated by the Corporation."
