Presenting Reports from Committees

Pursuant to Standing Order 109, the Committee requested that the government table a comprehensive response.

Mr. Jackson (Bruce--Grey--Owen Sound), from the Standing Committee on Transport and Government Operations, presented the Ninth Report of the Committee (Building a Transportation Security Culture: Aviation as the Starting Point). — Sessional Paper No. 8510-371-118.

Pursuant to Standing Order 109, the Committee requested that the government table a comprehensive response.

Introduction of Private Members' Bills

Pursuant to Standing Orders 68(2) and 69(1), on motion of Mr. Pratt (Nepean--Carleton), seconded by Mr. Jackson (Bruce--Grey--Owen Sound), Bill C-419, An Act to amend the Criminal Code (fire fighters), was introduced, read the first time, ordered to be printed and ordered for a second reading at the next sitting of the House.

Presenting Petitions

Pursuant to Standing Order 36, a petition certified correct by the Clerk of Petitions was presented as follows:

Government Orders

The House resumed consideration of the motion of Ms. McLellan (Minister of Justice), seconded by Mr. Goodale (Minister of Natural Resources), — That Bill C-46, An Act to amend the Criminal Code (alcohol ignition interlock device programs), be now read a second time and referred to the Standing Committee on Justice and Human Rights.

The debate continued.

The question was put on the motion and it was agreed to.

Accordingly, the Bill was read the second time and, by unanimous consent, deemed referred to a Committee of the Whole, deemed reported without amendment, deemed concurred in at report stage and deemed read the third time and passed.

Accordingly, the Bill was read the third time and passed.

Pursuant to Order made on Thursday, December 6, 2001, the Order was read for the consideration at report stage of Bill C-23, An Act to amend the Competition Act and the Competition Tribunal Act, as reported by the Standing Committee on Industry, Science and Technology with amendments.

Pursuant to Standing Order 76.1(5), the Speaker selected for debate the following motion:

Motion No. 1.

Ms. Dalphond-Guiral (Laval Centre), seconded by Mr. Bergeron (Verchères--Les-Patriotes), moved Motion No. 1, — That Bill C-23 be amended by adding after line 16 on page 28 the following new clause:

“1.31 The Act is amended by adding the following after section 77:

77.1 (1) A person who alleges that they are directly affected in their business or are precluded from carrying on business due to their inability to obtain adequate supplies of a product anywhere in a market may, with leave of the Tribunal, make an application under section 75.

(2) A person who alleges that they are directly affected in their business by exclusive dealing, tied selling or market restriction may, with leave of the Tribunal, make an application under section 77.

(3) No application may be made under section 75 or 77 by a person referred to in subsection (1) or (2) more than two years after the practice has ceased.

(4) Any person making an application under section 75 or 77 shall serve the person in respect of whom the order is sought and the Commissioner with a copy of the application for leave.

(5) The Tribunal shall give notice to the Commissioner of its decision on an application for leave pursuant to this section.

(6) Within thirty days of the granting of leave to a person to make an application under section 75 or 77, the Commissioner may become a party to the application but, after thirty days, may do so only at the request of or with leave of the Tribunal.

(7) Where an application is made to a court for an order under section 75 or 77 and the parties agree on the terms of the order and such terms are in accordance with the terms of this Act, whether or not any of the terms could have been imposed by the court under this Part, the order agreed to may be filed with the court for immediate registration.

(8) On being filed under subsection (7), an order shall be registered and, when registered, shall have the same force and effect, and all proceedings may be taken, as if the order had been made by the court.”

Mr. Boudria (Minister of State and Leader of the Government in the House of Commons) for Mr. Tobin (Minister of Industry), seconded by Mr. Gagliano (Minister of Public Works and Government Services), moved, — That Bill C-23, An Act to amend the Competition Act and the Competition Tribunal Act, as amended, be concurred in at report stage and read a second time.

The question was put on the motion and it was agreed to.

Accordingly, the Bill, as amended, was concurred in at report stage with further amendments and was read a second time.

The Order was read for the consideration at report stage of Bill C-43, An Act to amend certain Acts and instruments and to repeal the Fisheries Prices Support Act, as reported by the Standing Committee on Transport and Government Operations with amendments.

The question was put on the motion and it was agreed to.

Accordingly, the Bill, as amended, was concurred in at report stage.

Pursuant to Standing Order 76.1(11), Mr. Boudria (Minister of State and Leader of the Government in the House of Commons), seconded by Mr. Gagliano (Minister of Public Works and Government Services), moved, — That the Bill be now read a third time and do pass.
