Mr. White (North Vancouver) , seconded by Mr. Stinson (Okanagan—Shuswap) , moved the following amendment, — That the motion be amended by deleting all the words after the word “That” and substituting the following:

“Bill C-24, An Act to amend the Canada Elections Act and the Income Tax Act (political financing), be not now read a third time but be referred back to the Standing Committee on Procedure and House Affairs for the purpose of reconsidering Clause 40 with a view to investigating ways in which all taxpayer subsidies for political parties could be completely eliminated.”.

Debate arose thereon.

Pursuant to Standing Order 93(1), the House proceeded to the taking of the deferred recorded division on the motion of Mr. Paquette (Joliette) , seconded by Mr. Bergeron (Verchères—Les-Patriotes) , — That, in the opinion of this House, any free trade agreement entered into by Canada, whether bilateral or multilateral, must include rules for the protection of foreign investments which do not violate the ability of parliamentary and government institutions to act, particularly on behalf of the common good, and must exclude any investor-state redress provisions and consequently, the Canadian government must enter into negotiations with its American and Mexican partners with a view to bringing the North American Free Trade Agreement (NAFTA) in line with the aforementioned principles. By unanimous consent, it was ordered, — That, immediately before Government Orders are called on Thursday, June 12, 2003, the House shall proceed to the consideration at second reading of Bill S-5, An Act respecting a National Acadian Day, and after no more than one representative of each party has spoken for no more than five minutes each, the Bill shall be deemed read a second time, deemed referred to a Committee of the Whole, deemed reported without amendment, deemed concurred in at report stage and deemed read a third time and passed.

The House resumed consideration at report stage of Bill C-250, An Act to amend the Criminal Code (hate propaganda), as reported by the Standing Committee on Justice and Human Rights without amendment;

And of the motions in Group No. 1 (Motions Nos. 1 to 3).


Group No. 1

Motion No. 1 of Mr. Lee (Scarborough—Rouge River) , seconded by Mrs. Barnes (London West) , — That Bill C-250 be amended by adding after line 9 on page 1 the following new clause:

    “2. (1) Paragraph 319(3)(b) of the Act is replaced by the following:

    (b) if, in good faith, the person expressed or attempted to establish by an argument an opinion on a religious subject or an opinion based on a belief in a religious text;”

Motion No. 2 of Mr. Toews (Provencher) , seconded by Mr. Grewal (Surrey Central) , — That Bill C-250 be amended by adding after line 9 on page 1 the following new clause:

    “2. Subsection 319(6) of the the Act is replaced by the following:

    (6) No proceeding for an offence under subsection (1) or (2) shall be instituted without the consent of the Attorney General.”

Motion No. 3 of Mr. Toews (Provencher) , seconded by Mr. Grewal (Surrey Central) , — That Bill C-250 be amended by adding after line 9 on page 1 the following new clause:

    “3. The definition “hate propaganda” in subsection 320(8) of the Act is replaced by the following:

    “hate propaganda” means any writing, sign or visible representation that advocates or promotes genocide or the communication of which by any person would constitute an offence under section 319 and does not include any religious text or part thereof;”
