First Reading of Senate Public Bills

Pursuant to Standing Order 69(2), on motion of Mr. Easter (Malpeque), seconded by Mr. Savage (Dartmouth—Cole Harbour), Bill S-201, An Act to amend the Public Service Employment Act (elimination of bureaucratic patronage and geographic criteria in appointment processes), was read the first time and ordered for a second reading at the next sitting of the House.

Emergency Debate

Pursuant to Standing Order 52(10) and Order made earlier today, the House proceeded to the consideration of a motion to adjourn the House for the purpose of discussing an important matter requiring urgent consideration, namely, the operation of the Devils Lake outlet in the state of North Dakota.

Ms. Wasylycia-Leis (Winnipeg North), seconded by Mr. Martin (Sault Ste. Marie), moved, — That this House do now adjourn.

By unanimous consent, it was resolved, — That this House call on the government to continue to employ every means possible to have the flow of water from Devils Lake into the Canadian water system stopped immediately and to coordinate with the relevant authorities in North Dakota and the United States to ensure the principles of the August 2005 Joint Statement to halt the diversion of water from Devils Lake until adequate environmental and health protection measures, including the construction of an advanced filter, are respected.

1. Page 2, clause 5: Delete from line 36 the words:

“date of birth”

2. Page 6, clause 13:

(a) Delete on lines 14 and 15 the words:

“address and date of birth”; and

(b) Add on line 14, after the word “name” the words:

“and address”.

3. Page 7, clause 18: Replace line 35 with the following:

“does not indicate an elector’s sex or date of birth.”.
4. Page 13, clause 28: Replace lines 11 to 16 of the French text with the following:

5. Page 13, clause 28: Replace lines 12 to 17 with the following:
“(i.1) on request, and at intervals of no less than 30 minutes, provide to a candidate's representative, on the prescribed form and as directed by the Chief Electoral Officer, the identity of every elector who has exercised his or her right to vote on polling day, excluding that of electors who registered on that day;
(i.2) on request, after the close of the advance polling station, provide to a candidate's representative, on the prescribed form and as directed by the Chief Electoral Officer, the identity of every elector who has exercised his or her right to vote on that day excluding that of electors who registered on that day; and”.

6. Page 15, new clause 37.1: Add after line 30 the following:

“37.1 Subsection 487(1) of the Act is replaced by the following:
487. (1) Every person is guilty of an offence who contravenes
(a) paragraph 111(b) or (c) (applying improperly to be included on list of electors); or
(b) paragraph 111(f) (unauthorized use of personal information contained in list of electors).”.

7. Page 16, new clause 39.1: Add after line 29 the following:

“39.1 (1) Subsection 500(2) of the Act is replaced by the following:
(2) Every person who is guilty of an offence under any of subsection 485(1), paragraph 487(1)(a), subsections 488(1), 489(2) and 491(2), section 493 and subsection 495(2) is liable on summary conviction to a fine of not more than $1,000 or to imprisonment for a term of not more than three months, or to both.
(2) Section 500 of the Act is amended by adding the following after subsection (3):
(3.1) Every person who is guilty of an offence under paragraph 487(1)(b) is liable on summary conviction to a fine of not more than $5,000 or to imprisonment for a term of not more than one year, or to both.”.
8. Page 16, clause 40: Replace lines 30 to 39 with the following:
“40. The Public Service Employment Act is amended by adding the following after section 50:
50.1 Despite subsection 50(2), the maximum period of employment of casual workers appointed in the Office of the Chief Electoral Officer for the purposes of an election under the Canada Elections Act or a referendum held under the Referendum Act is 165 working days in one calendar year.”.

9. Page 17, clause 41: Delete clause 41.

10. Page 17, clause 42: Replace line 8 with the following:

“42. (1) Despite subsection 554(1) of the Canada Elections Act, sections 3, 6, 8 and 9, subsection”.

11. Page 17, clause 42: Replace line 9 with the following:

“10(2), sections 11, 12, 14 to 16, 20 to 27, 28 (f), (g) (h) and (i), 29 to 33 and”.

12. Page 17, clause 42: Replace line 23 with the following:
