Introduction of Private Members' Bills

Government Orders

The House resumed consideration of the motion of Mr. Nicholson (Minister of Justice), seconded by Mr. Thompson (Minister of Veterans Affairs), — That Bill C-26, An Act to amend the Controlled Drugs and Substances Act and to make consequential amendments to other Acts, be now read a second time and referred to the Standing Committee on Justice and Human Rights.

The debate continued.

The question was put on the motion and, pursuant to Standing Order 45, the recorded division was deferred until later today, at 5:30 p.m.


The Order was read for the second reading and reference to the Standing Committee on Public Safety and National Security of Bill S-3, An Act to amend the Criminal Code (investigative hearing and recognizance with conditions).

Mr. Emerson (Minister of International Trade and Minister for the Pacific Gateway and the Vancouver-Whistler Olympics) for Mr. Nicholson (Minister of Justice and Attorney General of Canada), seconded by Ms. Verner (Minister of Canadian Heritage, Status of Women and Official Languages), moved, — That the Bill be now read a second time and referred to the Standing Committee on Public Safety and National Security.

Deferred Recorded Divisions

Government Orders

At 5:30 p.m., pursuant to Standing Order 45, the House resumed consideration of the motion of Mr. Nicholson (Minister of Justice and Attorney General of Canada), seconded by Mr. Hill (Secretary of State), — That a message be sent to the Senate to acquaint their Honours that this House:

disagrees with amendment numbered 1 because it would place an undue burden on judges and does not take into consideration provincial and territorial practices that are currently in place to ensure that accused persons are informed of their language rights; and
disagrees with amendment numbered 3 because the Minister of Justice would be unable to comply with the statutory duty imposed by the amendment as provinces and territories do not keep statistics to report on the operation of the language of trial provisions.

The House proceeded to the taking of the deferred recorded division on the amendment of Mr. Murphy (Moncton—Riverview—Dieppe), seconded by Mr. LeBlanc (Beauséjour), — That the motion be amended by deleting the words “agrees with amendments numbered 2, 4, 5 and 6” and substituting therefore the words “agrees with amendments numbered 1, 2, 4, 5 and 6” and by deleting the paragraph commencing with the words “disagrees with amendment numbered 1”.

The Order was read for the second reading and reference to the Standing Committee on Justice and Human Rights of Bill C-384, An Act to amend the Criminal Code (mischief against educational or other institution).

Mrs. Freeman (Châteauguay—Saint-Constant), seconded by Mr. Ménard (Hochelaga), moved, — That the Bill be now read a second time and referred to the Standing Committee on Justice and Human Rights.

Debate arose thereon.

Pursuant to Standing Order 93(1), the Order was dropped to the bottom of the order of precedence on the Order Paper.

Messages from the Senate

Messages were received from the Senate as follows:

— ORDERED: That a message be sent to the House of Commons to acquaint that House that the Senate has passed Bill C-37, An Act to amend the Citizenship Act, without amendment.
— ORDERED: That a message be sent to the House of Commons to acquaint that House that the Senate has passed Bill C-40, An Act to amend the Canada Labour Code, the Canada Student Financial Assistance Act, the Canada Student Loans Act and the Public Service Employment Act, without amendment.
— ORDERED: That a message be sent to the House of Commons to acquaint that House that the Senate has passed Bill C-293, An Act respecting the provision of official development assistance abroad, with the following amendments:
1. Page 1, clause 2: Replace line 11 with the following:
“foreign policy, the principles of the Paris Declaration on Aid Effectiveness of March 2, 2005, sustainable development and”.
2. Page 2, clause 3:
(a) Replace lines 12 to 15 with the following:
““competent minister” means the Minister of International Cooperation, the Minister of Finance, the Minister of Foreign Affairs or any other minister who is providing official development assistance.”;
(b) Replace lines 30 and 31 with the following:
“rights conventions to which Canada is a party and on international customary law”.
3. Page 3, clause 4: Replace lines 18 to 21 with the following:
“(2) The competent minister shall consult with governments, international agencies and Canadian civil society organizations at least once every two years, and shall take their views and recommendations into consideration when forming an opinion described in subsection (1).”.
4. Page 4, clause 5: Add after line 35 the following:
“(4) Despite subsections (1) and (3), information shall not be reported under this section if its disclosure is prohibited by the policies of the Bretton Woods institutions.”.
