Mr. Rideout (Moncton), from the Standing Committee on Justice and Legal Affairs, presented the 3rd Report of the Committee (Bill C-41, An Act to amend the Divorce Act, the Family Orders and Agreements Enforcement Assistance Act, the Garnishment, Attachment and Pension Diversion Act and the Canada Shipping Act, with amendments). -- Sessional Paper No. 8510-352-45.

A copy of the relevant Minutes of Proceedings (Issue No. 5, which includes this Report) was tabled.

Presenting Petitions

Pursuant to Standing Order 36, petitions certified correct by the Clerk of Petitions were presented as follows:

-- by Mr. Harper (Simcoe Centre), one concerning the Young Offenders Act (No. 352-1176), one concerning sexual orientation (No. 352-1177) and one concerning the sexual exploitation of minors (No. 352-1178).

Questions on Order Paper

Mr. Zed (Parliamentary Secretary to the Leader of the Government in the House of Commons) presented the answer to question Q-75 on the Order Paper.

GOVERNMENT ORDERS

The Order was read for the consideration at report stage of Bill C-35, An Act to amend the Canada Labour Code (minimum wage), as reported by the Standing Committee on Human Resources Development without amendment.

Pursuant to Standing Order 76.1(5), the Speaker selected and grouped for debate the following motions:

Group No. 1

Mr. Ménard (Hochelaga -- Maisonneuve), seconded by Mr. Nunez (Bourassa), moved Motion No. 1, -- That Bill C-35, in Clause 1, be amended by replacing line 12 on page 1 with the following:

    "employee is usually employed or, if the employee works in more than one province, the minimum hourly rate of the province that is highest, and that is"

Debate arose on the motion in Group No. 1.

The question was put on Motion No. 1 and, pursuant to Standing Order 76.1(8), the recorded division was deferred.

Group No. 2

Mr. McClelland (Edmonton Southwest), seconded by Mr. Morrison (Swift Current -- Maple Creek -- Assiniboia), moved Motion No. 2, -- That Bill C-35, in Clause 1, be amended by deleting lines 1 to 8 on page 2.

Debate arose on the motion in Group No. 2.

The question was put on Motion No. 2 and it was negatived on division.

Pursuant to Standing Order 76.1(8), the House proceeded to the taking of the deferred recorded divisions at report stage of Bill C-35, An Act to amend the Canada Labour Code (minimum wage), as reported by the Standing Committee on Human Resources Development without amendment.

Pursuant to Standing Order 45, the deferred recorded divisions were further deferred until later today, at the expiry of the time provided for Government Orders.


The Order was read for the second reading and reference to the Standing Committee on Industry of Bill C-57, An Act to amend the Bell Canada Act.

Mr. Chan (Secretary of State (Asia-Pacific)) for Mr. Manley (Minister of Industry), seconded by Mr. MacAulay (Secretary of State (Veterans)(Atlantic Canada Opportunities Agency)), moved, -- That the Bill be now read a second time and referred to the Standing Committee on Industry.

Debate arose thereon.

The question was put on the motion and it was agreed to.

Accordingly, the Bill was read the second time and referred to the Standing Committee on Industry.


The House resumed consideration of the motion of Mr. Massé (President of the Treasury Board and Minister responsible for Infrastructure), seconded by Mr. Irwin (Minister of Indian Affairs and Northern Development), -- That Bill C-49, An Act to authorize remedial and disciplinary measures in relation to members of certain administrative tribunals, to reorganize and dissolve certain federal agencies and to make consequential amendments to other Acts, be now read a second time and referred to the Standing Committee on Government Operations;

And of the amendment of Mr. Bélisle (La Prairie), seconded by Mr. Rocheleau (Trois-Rivières), -- That the motion be amended by deleting all the words after the word "That" and substituting the following:

    "this House declines to give second reading to Bill C-49, An Act to authorize remedial and disciplinary measures in relation to members of certain administrative tribunals, to reorganize and dissolve certain federal agencies and to make consequential amendments to other Acts, because the principle of the said Bill does not allow for the possibility for any parliamentary mechanism governing the appointment or revocation of the appointment of members of administrative tribunals."
