PRIVATE MEMBERS' BUSINESS

At 11:00 a.m., pursuant to Standing Order 30(6), the House proceeded to the consideration of Private Members' Business.

The Order was read for the second reading and reference to the Standing Committee on Justice and Human Rights of Bill C-212, An Act to amend the Criminal Code and the Young Offenders Act (capital punishment).

Mr. Hill (Prince George -- Peace River), seconded by Mr. White (North Vancouver), moved, -- That the Bill be now read a second time and referred to the Standing Committee on Justice and Human Rights.

Debate arose thereon.

Pursuant to Standing Order 96(1), the Order was dropped from the Order Paper.

MOTIONS

By unanimous consent, it was ordered, -- That, after second reading, Bill C-22, An Act to implement the Convention on the Prohibition of the Use, Stockpiling, Production and Transfer of Anti-Personnel Mines and on their Destruction, will be referred to a Committee of the Whole, that the House shall be permitted to consider all stages of the Bill in this sitting, that, if the Bill has not been disposed of at the ordinary time of adjournment, the House shall continue to sit until it does dispose of the Bill, and that, if the House does sit after 6:30 p.m. this evening, no quorum calls or dilatory motions shall be received.

GOVERNMENT ORDERS

The Order was read for the second reading and reference to a Committee of the Whole of Bill C-22, An Act to implement the Convention on the Prohibition of the Use, Stockpiling, Production and Transfer of Anti-Personnel Mines and on their Destruction.

Pursuant to Standing Order 109, the government was requested by the Committee to table a comprehensive response.

Introduction of Private Members' Bills

Pursuant to Standing Orders 68(2) and 69(1), on motion of Mr. Bellehumeur (Berthier -- Montcalm), seconded by Ms. Picard (Drummond), Bill C-286, An Act to amend the Access to Information Act and amending the National Archives of Canada Act as a consequence (destruction and falsification of documents and access to confidences of the Privy Council), was introduced, read the first time, ordered to be printed and ordered for a second reading at the next sitting of the House.

By unanimous consent, Mr. Adams (Parliamentary Secretary to the Leader of the Government in the House of Commons), seconded by Mr. Bélair (Timmins -- James Bay), moved, -- That the 12th Report of the Standing Committee on Procedure and House Affairs, presented earlier today, be concurred in.

GOVERNMENT ORDERS

The House resumed consideration of the motion of Mr. Axworthy (Minister of Foreign Affairs), seconded by Mr. Manley (Minister of Industry), -- That Bill C-22, An Act to implement the Convention on the Prohibition of the Use, Stockpiling, Production and Transfer of Anti-Personnel Mines and on their Destruction, be now read a second time and referred to a Committee of the Whole.

The debate continued.

The question was put on the motion and it was agreed to.

Accordingly, the Bill was read the second time and referred to a Committee of the Whole.

The Committee considered the Bill and reported it with the following amendments:

Clause 10

Adding after line 39 on page 4 the following:

      ``techniques, but the number of such mines shall not exceed the minimum number absolutely necessary for the above- mentioned purposes.''

Clause 11

Replacing lines 13 to 16 on page 5 with the following:

      "(2) If a person objects to providing or fails to provide any requested document or information within the specified time, the Minister may apply to a judge of a superior court or the Federal Court -- Trial Division for an order requiring the person to provide it.
      (3) The Minister shall give the person at least seven days notice of the hearing of the application.
      (4) On hearing the application, the judge may order the person to provide the document or information if the judge concludes that, in the circumstances of the case, the productionof the document or information is necessary to ensure Canada's compliance with the Convention and that the public interest outweighs in importance the privacy interest of the person."

Clause 17

Replacing, in the French version, line 27 on page 8 with the following:

      ``réputation ou la dignité humaine de tout individu;''

Pursuant to Standing Order 76.1(12), Mr. Axworthy (Minister of Foreign Affairs), seconded by Mrs. Stewart (Minister of the Environment), moved, -- That Bill C-22, An Act to implement the Convention on the Prohibition of the Use, Stockpiling, Production and Transfer of Anti-Personnel Mines and on their Destruction, as amended be concurred in at report stage.

The question was put on the motion and it was agreed to.

Accordingly, the Bill as amended was concurred in at report stage.

Mr. Axworthy (Minister of Foreign Affairs), seconded by Mrs. Stewart (Minister of the Environment), moved, -- That the Bill be now read a third time and do pass.

Debate arose thereon.

MOTIONS

By unanimous consent, it was ordered, -- That, at the end of this day's debate at the third reading stage of Bill C-22, An Act to implement the Convention on the Prohibition of the Use, Stockpiling, Production and Transfer of Anti-Personnel Mines and on their Destruction, the question shall be deemed put and adopted unanimously.
