NOTICES OF MOTIONS FOR THE PRODUCTION OF PAPERS

The Notice of Motion for the Production of Papers P-14 was called pursuant to Standing Order 97(1) and was transferred by the Clerk to "Notices of Motions (Papers)".

GOVERNMENT ORDERS

The Order was read for the consideration at report stage of Bill C-22, An Act to facilitate combatting the laundering of proceeds of crime, to establish the Financial Transactions and Reports Analysis Centre of Canada and to amend and repeal certain Acts in consequence, as reported by the Standing Committee on Finance with amendments.

Pursuant to Standing Order 76.1(5), the Speaker selected and grouped for debate the following motions:

Group No. 1 -- Motion No. 1.

Group No. 2 -- Motions Nos. 2 to 7.

Group No. 3 -- Motions Nos. 8 to 11.

Group No. 1

Mr. Marceau (Charlesbourg), seconded by Ms. Venne (Saint- Bruno -- Saint-Hubert), moved Motion No. 1, -- That Bill C-22 be amended by adding after line 10 on page 3 the following new clause:

      "3.1 The persons and entities to which this Act applies shall not transfer to their clients, either directly or indirectly, any costs incurred by them in carrying out their obligations under this Act."

Debate arose on the motion in Group No. 1.

The question was put on Motion No. 1 and, pursuant to Standing Order 76.1(8), the recorded division was deferred.

Group No. 2

Mr. Marceau (Charlesbourg), seconded by Ms. Venne (Saint- Bruno -- Saint-Hubert), moved Motion No. 2, -- That Bill C-22 be amended by adding after line 47 on page 10 the following new clause:

      "19.1 If an officer decides, on grounds that the officer believes to be reasonable, to exercise any of the powers or perform any of the duties or functions under subsections 15(1) and (3), 16(1) and (2), 17(1) and 18(1), the officer shall record in writing the reasons for the decision."

Mr. Marceau (Charlesbourg), seconded by Ms. Venne (Saint- Bruno -- Saint-Hubert), moved Motion No. 3, -- That Bill C-22, in Clause 36, be amended by adding after line 22 on page 17 the following:

      "(3.1) If an officer decides, on grounds that the officer believes to be reasonable, to disclose information under subsection (2) or (3), the officer shall record in writing the reasons for the decision."

Mr. Marceau (Charlesbourg), seconded by Ms. Venne (Saint- Bruno -- Saint-Hubert), moved Motion No. 4, -- That Bill C-22, in Clause 55, be amended by adding after line 5 on page 26 the following:

      "(5.1) The Centre shall record in writing the reasons for all decisions to disclose information made under subsection (3) or paragraph (4)(a) or (5)(a)."

Mr. Marceau (Charlesbourg), seconded by Ms. Venne (Saint- Bruno -- Saint-Hubert), moved Motion No. 5, -- That Bill C-22, in Clause 56, be amended by adding after line 18 on page 27 the following:

      "(4) In every agreement or arrangement entered into under subsection (1) or (2), there shall be inserted an express condition that each party shall comply with the provisions of this Act dealing with the confidentiality and the collection and use of information."

Mr. Marceau (Charlesbourg), seconded by Ms. Venne (Saint- Bruno -- Saint-Hubert), moved Motion No. 6, -- That Bill C-22, in Clause 62, be amended by adding after line 3 on page 33 the following:

      "(1.1) If an authorized person decides, on grounds that the person believes to be reasonable, to enter premises under paragraph (1)(a), the person shall record in writing the reasons for the decision."

Mr. Marceau (Charlesbourg), seconded by Ms. Venne (Saint- Bruno -- Saint-Hubert), moved Motion No. 7, -- That Bill C-22, in Clause 63, be amended by replacing line 41 on page 33 with the following:

    "business, profession or activity, and shall record in writing the reasons for the person's belief."

Debate arose on the motions in Group No. 2.

By unanimous consent, Motions No. 5, 6 and 7 were withdrawn.

The House resumed consideration at report stage of Bill C-22, An Act to facilitate combatting the laundering of proceeds of crime, to establish the Financial Transactions and Reports Analysis Centre of Canada and to amend and repeal certain Acts in consequence, as reported by the Standing Committee on Finance with amendments;

Mr. McGuire (Parliamentary Secretary to the Minister of Agriculture and Agri-Food), seconded by Mr. Lee (Parliamentary Secretary to the Leader of the Government in the House of Commons), moved the following amendment, -- That Motion No. 2 be amended by replacing all of the words after the words "If an officer decides" with the following:

    "to exercise powers under subsection 18(1), the officer shall record in writing reasons for the decision."

Mr. McGuire (Parliamentary Secretary to the Minister of Agriculture and Agri-Food), seconded by Mr. Lee (Parliamentary Secretary to the Leader of the Government in the House of Commons), moved the following amendment, -- That Motion No. 3 be amended by deleting the following words:

    ", on grounds that the officer believes to be reasonable,"
