Government Orders

The Order was read for the consideration at report stage of Bill C-2, An Act providing for conflict of interest rules, restrictions on election financing and measures respecting administrative transparency, oversight and accountability, as reported by the Legislative Committee on Bill C-2 with amendments.

Pursuant to Standing Order 76.1(5), the Speaker selected and grouped for debate the following motions:

Mr. Baird (President of the Treasury Board), seconded by Mr. Toews (Minister of Justice and Attorney General of Canada), moved Motion No. 1, — That Bill C-2, in Clause 2, be amended by replacing line 12 on page 6 with the following:

“(2) No minister of the Crown, minister of state or parliamentary secretary shall, in his or her capacity as a member of the Senate or the House of Commons, debate or vote on a question that would place him or her in a conflict of interest.”

Mr. Baird (President of the Treasury Board), seconded by Mr. Toews (Minister of Justice and Attorney General of Canada), moved Motion No. 2, — That Bill C-2, in Clause 2, be amended

(a) by replacing, in the English version, line 10 on page 22 with the following:

“ministerial staff;”

(b) by replacing, in the English version, lines 16 and 17 on page 22 with the following:

“or decision-making power in the office of a minister of the Crown or a minister of state; and”

Mr. Baird (President of the Treasury Board), seconded by Mr. Toews (Minister of Justice and Attorney General of Canada), moved Motion No. 3, — That Bill C-2, in Clause 2, be amended by replacing line 1 on page 33 with the following:

“(2) Subject to subsection 6(2) and sections 21 and 30, nothing in this Act abrogates or dero-”

Mr. Baird (President of the Treasury Board), seconded by Mr. Toews (Minister of Justice and Attorney General of Canada), moved Motion No. 4, — That Bill C-2, in Clause 2, be amended by replacing lines 18 and 19 on page 33 with the following:

“67. (1) Within five years after the day on which this section comes into force, a comprehensive review”

Mr. Baird (President of the Treasury Board), seconded by Mr. Toews (Minister of Justice and Attorney General of Canada), moved Motion No. 6, — That Bill C-2, in Clause 78, be amended by deleting lines 4 to 8 on page 80.

Mr. Baird (President of the Treasury Board), seconded by Mr. Toews (Minister of Justice and Attorney General of Canada), moved Motion No. 7, — That Bill C-2 be amended by adding after line 42 on page 84 the following new clause:

“88.11 (1) Any member of a transition team referred to in section 88.1 may apply to the Commissioner of Lobbying for an exemption from that section.

(2) The Commissioner of Lobbying may, on any conditions that the Commissioner of Lobbying specifies, exempt the member from the application of section 88.1 having regard to any circumstance or factor that the Commissioner of Lobbying considers relevant, including the following:

(a) the circumstances under which the member left the functions referred to in subsection 88.1(5);

(b) the nature, and significance to the Government of Canada, of information that the member possessed by virtue of the functions referred to in subsection 88.1(5);

(c) the degree to which the member’s new employer might gain unfair commercial advantage by hiring the member;

(d) the authority and influence that the member possessed while having the functions referred to in subsection 88.1(5); and

(e) the disposition of other cases.

(3) The Commissioner of Lobbying shall without delay cause every exemption and the Commissioner of Lobbying’s reasons for it to be made available to the public.

(4) The Commissioner of Lobbying may verify the information contained in any application under subsection (1).”

Mr. Baird (President of the Treasury Board), seconded by Mr. Toews (Minister of Justice and Attorney General of Canada), moved Motion No. 9, — That Bill C-2, in Clause 99, be amended by deleting line 9 on page 89 to line 5 on page 90.

By unanimous consent, Mr. Baird (President of the Treasury Board), seconded by Mr. Toews (Minister of Justice), moved new Motion No. 9, — That Bill C-2, in Clause 99, be amended

By unanimous consent, Mr. Baird (President of the Treasury Board), seconded by Mr. Lukiwski (Parliamentary Secretary to the Leader of the Government in the House of Commons and Minister for Democratic Reform), moved Motion No. 5, — That Bill C-2, in Clause 75, be amended by adding after line 27 on page 76 the following:

“10.12 (1) Any person who is subject to this Act as if they were a senior public office holder by reason of subsection 2(3) may apply to the Commissioner for an exemption from section 10.11.

(2) The Commissioner may, on any conditions that the Commissioner specifies, exempt the person from the application of section 10.11 having regard to any circumstance or factor that the Commissioner considers relevant, including the following:

(a) the circumstances under which the person left the functions referred to in subsection 2(3);

(b) the nature, and significance to the Government of Canada, of information that the person possessed by virtue of the functions referred to in subsection 2(3);

(c) the degree to which the person’s new employer might gain unfair commercial advantage by hiring the person;

“16.1 (1) The following heads of government institutions shall refuse to disclose any record requested under this Act that contains information that was obtained or created by them or on their behalf in the course of an investigation, examination or audit conducted by them or under their authority:

(a) the Auditor General of Canada;

(b) the Commissioner of Official Languages for Canada;

(c) the Information Commissioner; and

(d) the Privacy Commissioner.

(2) However, the head of a government institution referred to in paragraph (1)(c) or (d) shall not refuse under subsection (1) to disclose any record that contains information that was created by or on behalf of the head of the government institution in the course of an investigation or audit conducted by or under the authority of the head of the government institution once the investigation or audit and all related proceedings, if any, are finally concluded.”

Pursuant to Order made Thursday, June 15, 2006, the House resumed consideration of the motion of Ms. Charlton (Hamilton Mountain), seconded by Mr. Masse (Windsor West), — That, in the opinion of the House, the government should rectify decades of underfunding of seniors programs by: (a) creating a Seniors Charter that recognizes older Canadians as creative, active and valued members of our society, and that this Charter shall enshrine the right of every senior living in Canada to the following: (i) income security, through protected pensions and indexed public income support that provides a reasonable state of economic welfare; (ii) housing, through secure accessible, and affordable housing; (iii) wellness, through health promotion and preventative care; (iv) health care, through secure, public, accessible, universal health care including primary care, dental care, homecare, palliative and geriatric care, and pharmacare; (v) self-development, through lifelong access to affordable recreation, education and training, (vi) government services, through timely access to all federal government services and programs, including family re-unification; and (b) creating a Seniors Advocate to: (i) conduct public education and awareness initiatives on the rights of seniors; (ii) ensure that all new or revised policies and programs affecting seniors receive public input from older persons; (iii) require that all new policies and programs affecting seniors are announced with specific timelines for implementation; (iv) act as an Ombudsman for seniors with respect to all government services and programs making recommendations as appropriate and that this Seniors Advocate publish and report annually to Parliament on government policies and programs affecting seniors, including the effectiveness of federal funding related to the needs of older persons;

The House proceeded to the taking of the deferred recorded division on the amendment of Ms. Guergis (Parliamentary Secretary to the Minister of International Trade), seconded by Ms. Verner (Minister of International Cooperation and Minister for la Francophonie and Official Languages), — That the motion be amended by adding after the words “government should” the following:

Pursuant to Standing Order 81(16), the House proceeded to the putting of the question on the motion, as amended, of Ms. Charlton (Hamilton Mountain), seconded by Mr. Masse (Windsor West), — That, in the opinion of the House, the government should work with the provinces to rectify decades of underfunding of seniors programs by: (a) creating a Seniors Charter that recognizes older Canadians as creative, active and valued members of our society, and that this Charter shall enshrine the right of every senior living in Canada to the following: (i) income security, through protected pensions and indexed public income support that provides a reasonable state of economic welfare; (ii) housing, through secure accessible, and affordable housing; (iii) wellness, through health promotion and preventative care; (iv) health care, through secure, public, accessible, universal health care including primary care, dental care, homecare, palliative and geriatric care, and pharmacare; (v) self-development, through lifelong access to affordable recreation, education and training, (vi) government services, through timely access to all federal government services and programs, including family re-unification; and (b) creating a Seniors Advocate to: (i) conduct public education and awareness initiatives on the rights of seniors; (ii) ensure that all new or revised policies and programs affecting seniors receive public input from older persons; (iii) require that all new policies and programs affecting seniors are announced with specific timelines for implementation; (iv) act as an Ombudsman for seniors with respect to all government services and programs making recommendations as appropriate and that this Seniors Advocate publish and report annually to Parliament on government policies and programs affecting seniors, including the effectiveness of federal funding related to the needs of older persons.

Mr. Godin (Acadie—Bathurst), seconded by Ms. Davies (Vancouver East), moved Motion No. 29, — That Bill C-2, in Clause 315, be amended by adding after line 27 on page 206 the following:

“(e) requiring the public disclosure of basic information on contracts entered into with Her Majesty for the performance of work, the supply of goods or the rendering of services and having a value in excess of $10,000.”

Mr. Baird (President of the Treasury Board), seconded by Mr. Nicholson (Leader of the Government in the House of Commons and Minister for Democratic Reform), moved Motion No. 30, — That Bill C-2, in Clause 315, be amended by replacing lines 19 to 25 on page 207 with the following:

“provincial government or a municipality, or any of their agencies;

(c.1) a band, as defined in subsection 2(1) of the Indian Act, or an aboriginal body that is party to a self-government agreement given effect by an Act of Parliament, or any of their agencies;”

By unanimous consent, it was ordered, — That Bill C-2, in Clause 181(2), be amended by replacing line 26 on page 132 with the following:

“(b) any parent Crown corporation, and any wholly-owned“.
