Pursuant to the order of reference of Tuesday, September 26, 2023, the committee resumed consideration of Bill C-33, An Act to amend the Customs Act, the Railway Safety Act, the Transportation of Dangerous Goods Act, 1992, the Marine Transportation Security Act, the Canada Transportation Act and the Canada Marine Act and to make a consequential amendment to another Act.

The witnesses answered questions.

The committee resumed its clause-by-clause study of the Bill.

The committee resumed clause-by-clause consideration on Clause 124 of the Bill.

Clause 124 carried.

On Clause 125,

Mark Strahl moved, — That Bill C-33, in Clause 125, be amended by adding after line 16 on page 80 the following:

“(6.‍1) Subsection 120(1.1) comes into force on January 1, 2031.”

After debate, the question was put on the amendment of Mark Strahl and it was negatived on the following recorded division:

By unanimous consent, the committee reverted to the consideration of the amendment of Mark Strahl previously stood which read as follows: That Bill C-33, in Clause 102, be amended by adding after line 18 on page 68 the following:

“(1.1) Section 14 of the Act is amended by adding the following after subsection (1.1):

(1.2) The board of directors of a port authority may appoint a director under paragraph (1)(a) or (d) if the position has been vacant for more than six months.”

Debate arose thereon.

Taylor Bachrach moved, — That the amendment be amended by

(a) replacing the word “six” with the word “twelve”

(b) adding the following after subsection (1.2):

“(1.3) The board of directors of a port authority shall give notice to the Minister of its intention to make an appointment under subsection (1.2) at least 90 days before doing so.”.
