The committee resumed its clause-by-clause study of the Bill.
The committee resumed clause-by-clause consideration on Clause 4 of the Bill.
“(1.1) No licence shall be issued or renewed under this Part in relation to a broadcasting undertaking, including one that distributes foreign programming, if the Commission determines that the person carrying on the broadcasting undertaking is — despite any measure that the Commission could take under this Part, including the making of an order or regulation — vulnerable to being significantly influenced by
(a) a foreign state, or a national of or person in a foreign state, as those terms are defined in section 2 of the Special Economic Measures Act, that is the subject of an order or regulation made under section 4 of that Act or that has been found to have committed genocide by a court or tribunal in Canada, the International Court of Justice, the International Criminal Court or a court or tribunal established under the authority of an international organization of states; or
(b) a foreign national, as defined in section 2 of the Justice for Victims of Corrupt Foreign Officials Act (Sergei Magnitsky Law), who is the subject of an order or regulation made under section 4 of that Act.
(1.2) The Commission shall not take any measure under this Part, including the making of an order or regulation, that would permit a distribution undertaking to distribute programming services provided by a person or entity that the Commission determines is, or is vulnerable to being significantly influenced by, a person or entity referred to in paragraph (1.1)(a) or (b).
(1.3) In determining, for the purposes of subsections (1.1) or (1.2), whether a person or entity is vulnerable to being significantly influenced, the Commission may consider the person’s or entity’s commercial relationships or any other factor that the Commission considers appropriate.”

Garnett Genuis moved, — That the amendment be amended by replacing the word “significantly” with the word “meaningfully”.

Heather McPherson moved, — That Bill C-281, in Clause 5, be amended by replacing line 18 on page 3 with the following:“mitments under the Convention, particularly its obligations under Article 5 (Victim assistance) and Article 6 (International cooperation and assistance) of the Convention, and to restrict invest‐”
