Pursuant to Standing Order 106(4), the committee commenced consideration of the request by members of the committee to undertake a study of a contract between Medicago and the Government of Canada.

Motion

Stephen Ellis moved, —

That, pursuant to Standing Order 108(1)(a), the committee order the production of unredacted copies of the vaccine supply contract between the Government of Canada and Medicago Inc. dated November 13, 2020, and, the committee order the production of all contracts between Medicago Inc, and the Department of Innovation, Science and Industry, under the Strategic Innovation Fund regarding the development of the COVID vaccines and the capital investment in Medicago’s manufacturing plant, and the committee order the production of all contracts between the Government of Canada, Medicago and the Aramis regarding the transfer of ownership of the former Medicago plant and the transfer of the intellectual property of Medicago’s COVID vaccine, further, the committee agrees to a study, of at least six meetings, to examine these contracts, and that the following witnesses be invited:

  1. Mark Holland, Minister of Health;
  2. François-Philippe Champagne, Minister of Innovation, Science, and Industry;
  3. Assistant to the Deputy Minister of the Strategic Innovation Fund, Department of Innovation, Science and Industry;
  4. Officials from the Public Health Agency of Canada;
  5. the President of Medicago;
  6. the President of Aramis; and
  7. any other witnesses deemed relevant by the committee;

    and, that the committee prepare a report with its findings for the House.

At 11:12 a.m., the sitting was suspended.

At 11:24 a.m., the sitting resumed.

Amendment

Brendan Hanley moved, — That the motion be amended by deleting all the words after “November 13, 2020” and adding the following: “, and that, when these documents are received by the clerk, they be available at the clerk's office for viewing by committee members only, for one week to be designated by the committee no later than 30 days following the receipt of the contracts, under the supervision of the clerk and that no personal mobile, electronic or recording devices of any kind be permitted in the room that week; and that no notes be taken out of the room.”.

Debate arose thereon.

At 11:43 a.m., the sitting was suspended.

At 11:48 a.m., the sitting resumed.

A point of order was raised as to the procedural acceptability of the proposed amendment moved by Brendan Hanley.

RULING BY THE CHAIR

The Chair ruled the proposed amendment admissible as it remains consistent with the spirit of the motion which is the production of documents.

Whereupon, Rick Perkins appealed the decision of the Chair.

The question: "Shall the decision of the Chair be sustained?" was put and the decision was sustained on the following recorded division:

YEAS: Jenica Atwin, Don Davies, Brendan Hanley, Majid Jowhari, Marcus Powlowski, Sonia Sidhu — 6;

NAYS: Stephen Ellis, Shuvaloy Majumdar, Pierre Paul-Hus, Rick Perkins, Julie Vignola — 5.

Accordingly, the Chair's decision was sustained as the question was not negatived.

The debate on the amendment continued.

Subamendment

Marilyn Gladu moved, — That the amendment be amended by deleting the words “at the clerk’s office for viewing by”, “only, for one week to be designated by the committee” and “, under the supervision of the clerk and that no personal mobile, electronic or recording devices of any kind be permitted in the room that week; and that no notes be taken out of the room.”.

Debate arose thereon.

At 12:17 p.m., the sitting was suspended.

At 12:22 p.m., the sitting resumed.

The question was put on the subamendment of Marilyn Gladu and it was negatived on the following recorded division:

The motion, as amended, read as follows:
