The committee proceeded to the consideration of matters related to committee business.

Rachael Thomas gave notice of the following motion:

Given that,

The CBC receives $1.4 billion from taxpayers;

The CBC holds the rights to broadcast the NHL playoffs;

The CBC chose not to broadcast the Edmonton Oilers game that sent them to the Stanley Cup finals;

The committee calls on the CBC to commit to broadcasting all Stanley Cup final games and report this finding to the House.

Pursuant to the order of reference of Wednesday, November 22, 2023, the committee resumed consideration of Bill C-316, An Act to amend the Department of Canadian Heritage Act (Court Challenges Program).

The witnesses answered questions.

The committee resumed its clause-by-clause study of the Bill.

The committee resumed clause-by-clause consideration on Clause 3 of the Bill.

The committee resumed consideration of the amendment of Taleeb Noormohamed, as amended, — That Bill C-316, in Clause 3, be amended by

(a) replacing lines 19 to 21 on page 2 with the following:

“5.1 (1) The independent organization responsible for administering the program referred to in section 7.1 of this Act and paragraph 43(1)(c) of the Official Languages Act shall, each year, submit to”

(b) replacing line 28 on page 2 with the following:

“ous year and any outreach and promotional activities that were conducted with groups affected by these cases.”

The committee resumed consideration of the subamendment of Rachael Thomas, — That the amendment, as amended, be amended by adding after the words “ous year” the following:

“and financial performance of the program, as well as a list of all the cases that received funding, and the amount provided for each case.”.

“4.1 Within six months after the day on which this Act comes into force, the Minister of Canadian Heritage shall enter into a framework agreement with the Government of Quebec for the purpose of making an arrangement respecting the management of any program established under paragraph 5(a.1) of the Department of Canadian Heritage Act.”

“Whereas the Government of Canada recognizes that there are English or French linguistic minority communities in every province and territory and that the English linguistic minority community in Quebec and the French linguistic minority communities in the other provinces and the territories have different needs;”

The Chair ruled the proposed amendment inadmissible because it was beyond the scope of the Bill, as provided on page 770 of House of Commons Procedure and Practice, Third Edition.

Martin Champoux moved, — That Bill C-316, in the preamble, be amended by adding after line 12 on page 1 the following:

“Whereas the Official Languages Act recognizes the diversity of the provincial and territorial language regimes, including the fact that Quebec's Charter of the French language provides that French is the official language of Quebec;”

The Chair ruled the proposed amendment inadmissible because it was beyond the scope of the Bill, as provided on page 770 of House of Commons Procedure and Practice, Third Edition.

Taleeb Noormohamed moved, — That Bill C-316, in the preamble, be amended by replacing lines 13 and 14 on page 1 with the following:

Martin Champoux moved, — That Bill C-316, in the preamble, be amended by adding after line 19 on page 1 the following:

“Whereas Parliament recognizes that, of the two official languages, French is in a minority situation in Canada and North America due to the predominant use of English and that language rights are to be interpreted by taking that fact into account.”

The Chair ruled the proposed amendment inadmissible because it was beyond the scope of the Bill, as provided on page 770 of House of Commons Procedure and Practice, Third Edition.

Martin Champoux moved, — That Bill C-316, in the preamble, be amended by adding after line 19 on page 1 the following:

“Whereas the House of Commons has recognized that the Québécois form a nation;

Whereas, on May 24, 2022, the National Assembly of Québec passed An Act respecting French, the official and common language of Québec, which amended the Constitution Act, 1867 to state that Quebecers form a nation, that French is the only official language of Quebec and that it is the common language of the Quebec nation;

Whereas the Supreme Court of Canada has acknowledged that Quebec has distinct legal traditions and social values;

Whereas the rights of nations with distinct legal traditions and social values must be interpreted in a differential manner;”

The Chair ruled the proposed amendment inadmissible because it was beyond the scope of the Bill, as provided on page 770 of House of Commons Procedure and Practice, Third Edition.

    ii. Deadline for amendments on C-354 is 12:00 p.m., and
