Pursuant to the order of reference of Monday, March 27, 2023, the committee resumed consideration of Bill C-41, An Act to amend the Criminal Code and to make consequential amendments to other Acts.

The witnesses answered questions.

The committee commenced its clause-by-clause study of the Bill.

The Chair called Clause 1.

Heather McPherson moved, — That Bill C-41, in Clause 1, be amended

(a) by replacing line 8 on page 1 with the following:

“10 years who, directly or indirectly, wilfully and without lawful justification or excuse, collects property or”

(b) by replacing line 18 on page 1 with the following:

“years who, directly or indirectly, wilfully and without lawful justification or excuse, collects property or pro‐”

After debate, the question was put on the amendment of Heather McPherson and it was agreed to.

Heather McPherson moved, — That Bill C-41, in Clause 1, be amended

(a) by replacing line 22 on page 1 with the following:

“a listed entity.”

(b) by replacing line 1 on page 3 with the following:

“in the listed entity using or benefiting from the prop‐”

(c) by replacing line 38 on page 3 with the following:

“in which a listed entity may use or benefit from”

(d) by replacing line 15 on page 4 with the following:

“that, in whole or in part, a listed entity will use or”

(e) by replacing line 1 on page 5 with the following:

“association with a listed entity in carrying out the”

After debate, the question was put on the amendment of Heather McPherson and it was negatived on the following recorded division:

Heather McPherson moved, — That Bill C-41, in Clause 1, be amended

(a) by adding after line 26 on page 1 the following:

“(4) Subsections (1) and (2) do not apply to a person who carries out any of the acts referred to in those subsections for the sole purpose of carrying out humanitarian assistance activities conducted under the auspices of impartial humanitarian organizations in accordance with international humanitarian law.”

(b) by deleting lines 15 to 19 on page 2.

The Chair ruled the proposed amendment inadmissible because it was contrary to the principle of the Bill, as provided on page 770 of House of Commons Procedure and Practice, Third Edition.

Whereupon, Alexis Brunelle-Duceppe appealed the decision of the Chair.

The question: "Shall the decision of the Chair be sustained?" was put and the decision was overturned on division.

Debate arose thereon.

Garnett Genuis moved, — That the amendment be amended by adding after the word “law” the following: “while using reasonable efforts to minimize any benefit to terrorist groups”.

After debate, the question was put on the subamendment of Garnett Genuis and it was agreed to on the following recorded division:

YEAS: Élisabeth Brière, Larry Brock, Alexis Brunelle-Duceppe, Pam Damoff, Anju Dhillon, Lena Metlege Diab, Garnett Genuis, Heather McPherson, Rob Moore, Yasir Naqvi, Tako Van Popta — 11;

After debate, the question was put on the amendment of Heather McPherson, as amended, and it was agreed to on the following recorded division:

(a) by replacing lines 10 and 11 on page 2 with the following:

(b) by replacing lines 36 and 37 on page 2 with the following:

“(2) For the purposes of this section, a listed entity substantially controls a geographic area if the entity exerts significant”

(c) by replacing line 29 on page 3 with the following:

“substantially controlled by a listed entity;”

Debate arose thereon.

Garnett Genuis moved, — That the amendment be amended by replacing the words “listed entity” with the words “terrorist group” in parts (a), (b) and (c).

After debate, the question was put on the subamendment of Garnett Genuis and it was agreed to on division.

After debate, the question was put on the amendment of Heather McPherson, as amended, and it was negatived on the following recorded division:

Garnett Genuis moved, — That Bill C-41, in Clause 1, be amended by replacing line 12 on page 2 with the following:

“hibited under this Part — or a specified class of”

The Chair ruled the proposed amendment inadmissible because it was beyond the scope of the Bill, as provided on page 770 of House of Commons Procedure and Practice, Third Edition.

Whereupon, Garnett Genuis appealed the decision of the Chair.

At 4:56 p.m., the sitting was suspended.

At 5:05 p.m., the sitting resumed.

At 5:08 p.m., the committee adjourned to the call of the Chair.
