The committee commenced its clause-by-clause study of the Bill.
The Chair called Clause 1.
On Clause 1,
Rhéal Éloi Fortin moved, — That Bill S-224, in Clause 1, be amended(a) by replacing line 4 on page 1 with the following:
“1 Subsections 279.04(1) and (2) of the Criminal Code are”
(b) by replacing lines 14 and 15 on page 1 with the following:
“of trust, power or authority, or any other similar act by which they take advantage of the other person's vulnerability.
(2) In determining whether an accused is exploiting another person under subsection (1), the court may consider, among other factors, whether the victim
(a) fears for their safety or the safety of a person known to them; and
(b) is able to give informed consent considering their age or other personal circumstances, such as their financial situation or mental condition.”
After debate, the question was put on the amendment of Rhéal Éloi Fortin and it was negatived.
At 5:20 p.m., the sitting was suspended.
At 5:21 p.m., the sitting resumed.
Clause 1 was negatived.
The Title was negatived.
The Bill, as amended, was adopted.
ORDERED, — That the Chair report the Bill, as amended, to the House.
Randall Garrison gave notice of the following motion:
That, given the rising tide of hate and violence directed toward the 2SLGBTQI+ community at home and around the world, the House call on leaders at all levels of government in Canada to:
- speak out strongly in favour of Canadian values of equality and inclusion for the 2SLGBTQI+ community;
- deplore all disruptions of lawful public activities including Pride events and all children’s sport and educational activities; and
- condemn all attempts to disrupt democratic institutions including school boards when dealing with policies concerning equality and inclusion.
