The committee commenced its clause-by-clause study of the Bill.
Pursuant to Standing Order 75(1), consideration of the Preamble was postponed.
The Chair called Clause 1.
On Clause 1,
James Maloney moved, — That Bill C-321, in Clause 1, be amended by replacing line 19 on page 1 with the following:“the commission of the offence, a person who provides health services, including personal care services,”
Debate arose thereon.
Rhéal Éloi Fortin moved, — That Motion G-1, proposing to amend Clause 1 of Bill C-321 by replacing line 19 on page 1, be amended by
(a) replacing “line 19” in the opening portion with “lines 17 to 19”
(b) adding the following before “the commission”:
“to 269, it may consider as an aggravating circumstance the fact that the victim of the offence was, at the time of ”
At 4:05 p.m., the sitting was suspended.
At 4:10 p.m., the sitting resumed.
After debate, the question was put on the subamendment of Rhéal Éloi Fortin and it was negatived, by a show of hands: YEAS: 1; NAYS: 10.
After debate, the question was put on the amendment of James Maloney and it was agreed to.
“(2) For the purpose of subsection (1), first responder means a person who is employed, or formally engaged on a volunteer basis, to be among the first on the scene of an accident, fire or other emergency to provide medical assistance or firefighting services, and includes an emergency medical technician, a paramedic and a firefighter.”
After debate, the question was put on the amendment of Rob Moore and it was negatived on the following recorded division:
YEAS: Frank Caputo, Rhéal Éloi Fortin, Rob Moore, Tako Van Popta, Kevin Waugh — 5;
NAYS: Élisabeth Brière, Don Davies, Anju Dhillon, Anthony Housefather, James Maloney, Marco Mendicino — 6.
Clause 1, as amended, carried.
On Preamble,
James Maloney moved, — That Bill C-321, in the preamble, be amended by(a) replacing line 2 on page 1 with the following:
“involving violence against persons who provide health services”
(b) replacing line 4 on page 1 with the following:
“Whereas assaults on persons who provide health services and”
(c) replacing line 7 on page 1 with the following:
“And whereas persons who provide health services and first re-”
After debate, the question was put on the amendment of James Maloney and it was agreed to.
The Preamble, as amended, carried.
On Title,
James Maloney moved, — That Bill C-321 be amended by replacing the long title on page 1 with the following:“An Act to amend the Criminal Code (assaults against persons who provide health services and first responders)”
After debate, the question was put on the amendment of James Maloney and it was agreed to.
The Title, as amended, carried.
The Bill, as amended, was adopted.
ORDERED, — That the Chair report the Bill, as amended, to the House.
ORDERED, — That Bill C-321, as amended, be reprinted for the use of the House of Commons at report stage.
On motion of Tako Van Popta, it was agreed, — That the members of the committee submit to the clerk all of their proposed amendments to Bill C-40, An Act to amend the Criminal Code, to make consequential amendments to other Acts and to repeal a regulation (miscarriage of justice reviews), no later than 12:00 p.m. on Friday, December 1, 2023.
