Pursuant to Standing Order 108(3)(c) and the motion adopted by the committee on Monday, October 17, 2022, the committee resumed its study of the ArriveCAN application.

Motion

Larry Brock moved, — That the evidence to be given by Minh Doan in relation to the ArriveCan Application be taken under oath or by solemn affirmation.

Minh Doan, having made a solemn affirmation, made a statement and answered questions.

At 5:48 p.m., the meeting was suspended.

At 5:54 p.m., the meeting resumed.

Questioning of the witness resumed.

At 6:19 p.m., the meeting was suspended.

At 6:25 p.m., the meeting resumed.

Questioning of the witness resumed.

At 6:52 p.m., the meeting was suspended.

At 7:03 p.m., the meeting resumed.

Questioning of the witness resumed.

It was agreed, — That the clerk contact the Canada Border Services Agency to ask whether there are intact backup copies of Minh Doan’s emails from when he was an employee of the Agency.

It was agreed, — That, as part of its study of the ArriveCAN application, the committee order the production of all text messages between Cameron Macdonald and Minh Doan, from 2018 to present.

Motion

Garnett Genuis moved, — That the committee instruct the clerk and analysts to prepare a report to the House, which the Chair shall table forthwith, outlining the potential breach of privilege concerning Minh Doan’s refusal to answer those questions which the committee agreed to put to him and his prevarication in answering others.

After debate, the question was put on the motion and it was negatived on the following recorded division:

NAYS: Jenica Atwin, Taylor Bachrach, Parm Bains, Majid Jowhari, Irek Kusmierczyk, Charles Sousa, Julie Vignola — 7.
